Real Estate Disposition Policy
The following basic policy statements shall apply to the disposition of any College real estate (land and buildings):
Alternative and Future Use Considerations:
- For real estate deemed surplus, obsolete, or underutilized, administration shall carefully consider potential alternative uses for the real estate, College needs, and future benefit of the property before making a recommendation for disposition. Alternative uses should seek to enhance or diversify net revenue, support an NMC program, partner, or community need, and align with NMC’s mission, vision, and values.
Disposition Considerations:
- Real estate may be sold, donated, or traded at the sole discretion of the board in accordance with Board Policy A-106.00: Items for Specific Board Approval
- The President shall recommend to the Board the method and procedure for disposition on a case-by-case basis. Methodologies might include, but are not limited to, public listing (MLS), a proposal process, public auction, a donation, or a real estate trade.
- Any property recommended for disposition must have been appraised within three years of the decision to dispose of it.
- The Board is in no way obligated to act or accept an offer or proposal which is received.
The Vice President for Finance and Administration is responsible for developing and publishing any procedures or guidelines necessary to administer this policy effectively. If any provision(s) of this policy or set of bylaws conflicts with laws applicable to Northwestern Michigan College, including the Community College Act of 1966, the Freedom of Information Act, or the Open Meetings Act, as each may be amended from time to time, such laws shall control and supersede such provision(s).
